One thing that many people do not realize is that when someone dies – often the Will of the deceased person is in the office of the law firm that prepared the Will. Many people assume that the law firm that prepared the Will must be used to do the estate work.
This is entirely incorrect.
After the person has died the family of a deceased person has no obligation whatsoever to retain the law firm that prepared the Will. The family can choose any lawyer that they want to handle the estate.
The plain fact is that many law firms who have the Will in their possession will browbeat and intimidate the client – make them believe that they have no choice in the matter... and essentially coerce the family into using their law firm to do the estate work.
A lot of money can be at stake and some lawyers will really turn up the heat on a family at a vulnerable and confusing time.
To make matters worse - many law firms will then charge an exorbitant fee for the estate work.
The truth is that estate work is fairly routine and straightforward and much of it can be done by a paralegal under the careful direction of a lawyer. Because of that fact the cost to process an estate certainly does not warrant a substantial fee – certainly not what some lawyers are charging.
If someone has died within the family – give me a call. At no charge I can explain the options and provide a quote that is reasonable.
And distance is not an issue – I service estates throughout Ontario – and I am prepared to go to your home when papers must be signed.
If you decide to use my law office – all you have to do is sign a 'direction' addressed to the law firm holding the Will... and I or a member of my staff shall personally pick up the Will and take it from there. You do not have to deal with that law firm in any way – just leave everything to us.
