HENSON TRUST
A Henson trust is a type of trust that is placed within a Will and is designed for children who are disabled and are collecting some sort of pension or entitlement from the government.
The problem is that if a disabled child is left an inheritance in a Will then they will probably lose their government pension and other entitlements. The potential loss of a pension and entitlements is a huge concern for parents and grandparents.
A Henson trust – properly drafted – will allow the disabled person to receive part of their inheritance on a yearly or monthly basis and in a reasonable manner that will not effect their pension and other entitlements.
I have in my family children who are disabled and I know and appreciate the concerns of the parents and grandparents of these children.
I find that lawyers in Ontario generally charge a significant fee for Wills containing a Henson trust.
I do not think that a Will containing a Henson Trust deserves to be billed at a premium rate. To prepare a Will with a Henson Trust is more work but certainly not worth what some lawyers will charge.
